Details:
The Ontario Court of Justice found the member guilty of:
- 2 counts of personating another person with intent to gain advantage, contrary to Section 403(1)(a) of the Criminal Code of Canada; and
- unlawfully did by deceit, falsehood or other fraudulent means attempt to defraud an organization of a sum of money, of a value not exceeding five thousand dollars, contrary to Section 463(d) of the Criminal Code of Canada.
The Ontario Court of Justice sentenced the member on December 21, 2015 to the following:
- a victim surcharge;
- 18 month conditional sentence including but not limited to the following:
- remain in his residence except for approved purposes;
- remain at least 100 metres away from West Park Health Care Centre, The Health Team and St. Mary’s of the Lake Hospital;
- must not communicate with or be in the presence of individuals specified by the court;
- 90 hours of community service;
- must not practice or be employed as a Registered Nurse;
- must not hold himself out to be or impersonate an RN; and
- Three years’ probation including, but not limited to the following conditions:
- remain at least 100 metres away from West Park Health Care Centre, The Health Team and St. Mary’s of the Lake Hospital;
- must not communicate with or be in the presence of individuals specified by the court;
- must not practice or be employed as a Registered Nurse; and
- must not hold himself out to be or impersonate an RN.

Finding Details:
The member was found to have committed professional misconduct in that he:
- was found guilty of criminal offences in December 2015 which are relevant to his suitability to practise and engaged in disgraceful, dishonourable and unprofessional conduct by fraudulently personating two individuals in 2013 and 2014 with intent to gain employment and attempting to defraud a facility of a value not exceeding $5000 in 2014;
- contravened a term, condition or limitation on his certificate of registration and engaged in disgraceful, dishonourable and unprofessional conduct by failing to provide the College with details of criminal charges laid against him in June 2015 and findings of guilt made against him in December 2015 including fraudulently personating two individuals with intent to gain employment and attempting to defraud a facility of a value not exceeding $5000;
- contravened the Nursing Act, 1991 and engaged in disgraceful, dishonourable and unprofessional conduct by failing to report to the College after being found guilty of offences under the Criminal Code of Canada in December 2015 including fraudulently personating two individuals with intent to gain employment and attempting to defraud a facility of a value not exceeding $5000;
- failed to abide with a written agreement entered into with the College and engaged in disgraceful, dishonourable and unprofessional conduct by applying for employment in a nursing role in or about June 2016 when he had voluntarily surrendered his certificate of registration and agreed not to engage in the practice of nursing until such time as his certificate was returned to him; and
- engaged in disgraceful, dishonourable and unprofessional conduct by applying for employment in a nursing role in or about June 2016 when he was subject to a conditional sentence order and a probation order which prohibited him from practising, being employed as a nurse and holding himself out to be or impersonating a nurse, submitting applications for nursing employment and maintaining a public profile from about April 2017 to January 2018, which he knew contained false or misleading statements in respect of his academic credentials and/or his employment history.

Finding Details:
The member was found to have committed professional misconduct between 2008 and 2010 in that he:
- was found guilty of offences relevant to his suitability to practise including committing fraud over $5000 and uttering forged documents in February 2009;
- engaged in disgraceful, dishonourable and unprofessional conduct and contravened the Nursing Act, 1991, when he held himself out as a nurse and used the title of nurse when his registration was suspended and when he failed to report and provide the College with details of his findings of guilt; and
- contravened the standards of practice of the profession and engaged in disgraceful, dishonourable and unprofessional conduct in that while applying for employment at three facilities, he submitted applications containing false and misleading statements about his academic and employment history and references, provided altered police record checks on two occasions to his employer and impersonated his references.
