Details:
The Ontario Court of Justice found the member guilty of:
- 1 count of knowing a document to be forged, did use, deal with or act on it as if it were genuine, contrary to Section 368(1)(a) of the Criminal Code of Canada.
The Ontario Court of Justice sentenced the member on December 19, 2017 to the following:
- a conditional discharge;
- a victim surcharge; and
- 6 months probation including, the following conditions:
-keep the peace and be of good behaviour;
-appear before the court when required to do so;
-notify the court or probation officer in advance of any change of name or address, and promptly notify the court or probation officer of any change in employment or occupation;
-must not communicate with or be in the presence of individuals specified by the court, except for employment purposes.

Finding Details:
The member was found to have committed professional misconduct in that he:
- was found guilty of an offence that is relevant to his suitability to practice in December 2017, specifically, of knowingly using a forged document, contrary to s. 368(1)(a) of the Criminal Code of Canada;
- contravened a term, condition or limitation on his certificate of registration and engaged in disgraceful, dishonourable and unprofessional conduct by failing to provide the Executive Director of CNO the details of his charge and finding of guilt with respect to knowingly using a forged document;
- contravened a provision of the Regulated Health Professions Act, 1991 by failing to report his finding of guilt to the Executive Director of CNO;
- failed to keep records as required, contravened the standards of practice of the profession and engaged in disgraceful, dishonourable and unprofessional conduct in March and June 2017 by documenting that he administered medications to two patients when he had not; and
- contravened the standards of practice of the profession and engaged in disgraceful, dishonourable and unprofessional conduct by providing inadequate care to four patients: in March 2017 by failing to respond appropriately when he was informed that a patient was choking and failing to appropriately document, report and follow up on the patient; by attempting to administer medication to a patient in food contrary to the patient’s order and failing to appropriately dispose of the patient’s medication; in March and June 2017 by failing to administer medications to two patients as ordered, failing to appropriately document, report, follow-up on and investigate the medications which were not administered to the patients; and in June 2017 by failing to administer medication to a patient and check the patient’s blood sugar in accordance with the patient’s orders.

The Discipline Committee ordered that the member’s certificate of registration be suspended for 6 months; required the member to appear before the panel to be reprimanded; and imposed the following terms, conditions and limitations on the member’s certificate of registration:

- May not engage in independent nursing practice for a period of time
- Must inform employer(s) of results of discipline hearing
- Must inform College of all nursing employer(s) for a period of time
- Employer(s) to provide specified reports to College for a period of time
