It is alleged that the member committed professional misconduct in that the member:
- misappropriated property from a client or workplace, contravened the standards of practice of the profession and engaged in disgraceful, dishonourable or unprofessional conduct in or about July 2021 by misappropriating a controlled substance, namely hydromorphone, from a vial or vials at the facility;
- contravened a term, condition or limitation on the member’s certificate of registration, contravened a provision of the Nursing Act, 1991, the Regulated Health Professions Act, 1991 or the regulations under either of those Acts and engaged in disgraceful, dishonourable or unprofessional conduct by failing to provide the Executive Director of CNO with the details of the criminal charge of theft contrary to section 334(b) of the Criminal Code of Canada laid against the member on or about August 3, 2021; and/or
- contravened the standards of practice of the profession and engaged in disgraceful, dishonourable or unprofessional conduct in or about July 2021 by improperly handling and/or improperly disposing of a controlled substance, namely hydromorphone; and/or by failing to adequately document the member’s handling and/or disposal of a controlled substance, namely hydromorphone.

Finding Details:
The member was found to have committed professional misconduct in that he:
-
misappropriated property from a patient or workplace; contravened the standards of practice of the profession; submitted an account or charge for services that he knew was false or misleading; and engaged in dishonourable and unprofessional conduct during his employment at Victorian Order of Nurses between June 2017 and September 2017 by requesting to be paid, and being paid, for time and overtime he had not worked;

contravened the standards of practice of the profession; falsified a record relating to his practice; failed to keep records as required; and engaged in dishonourable and unprofessional conduct during his employment at Saint Elizabeth Health Care in April 2018 by falsifying the Palliative Care Pain and Symptom Screening Flow Sheet record for a patient;

contravened the standards of practice of the profession; submitted an account or charge for services he knew was false or misleading; and engaged in dishonourable and unprofessional conduct during his employment at Victorian Order of Nurses between June 2017 and September 2017 by falsely recording visit times on the CellTrak application by logging out of a visit after he had already departed the visit;

contravened the standards of practice of the profession; failed to keep records as required; and engaged in dishonourable and unprofessional conduct during his employment at Saint Elizabeth Health Care in April 2018 by failing to document his wasting and disposal of a patient’s medication, including hydromorphone; failing to document the practice draws of the patient’s medication made by a preceptee nurse he was supervising, including of hydromorphone; failing to document the count remaining of the patient’s medication after his death; failing to complete accurate documentation in respect of care provided to the patient, including the times of events; failing to document his discussion with the patient’s spouse about her administration of medication to the patient prior to his arrival; failing to accurately and legibly document the time and dose of medication administered to the patient; failing to document the rationale for the administration of medication to the patient; failing to document the DNR status in the night chart of the patient; failing to document that he offered to call 911 on two occasions in respect of the patient; failing to document that he inserted a subcutaneous injection site for the patient; failing to document the patient’s vital signs and blood pressure; failing to complete and document an appropriate care plan for the patient; failing to record any assessment data for the patient; failing to maintain the Nursing History and Physical Assessment and Palliative Care Pain and Symptom Screening Flow Sheet records for the patient properly within the patient’s night chart; failing to adequately document assessment data and care provided to two different patients in November 2017 and April 2018; and failing to document an incident involving another patient becoming agitated and uncomfortable after rolling onto her stomach and the member’s need to obtain the assistance of the patient’s daughter in May 2018;

contravened the standards of practice of the profession and engaged in dishonourable and unprofessional conduct during his employment at Victorian Order of Nurses in September 2017 during a joint supervisory visit by failing to follow appropriate hand hygiene and infection control procedures; failing to have in his possession an up-to-date medical directive for anaphylaxis epinephrine; failing to check the medication Order prior to administering IV antibiotics; and failing to prepare and administer medication safely when he failed to check the 8 rights of medication administration (patient, medication, reason, dose, frequency, route, site and time); and

contravened the standards of practice of the profession and engaged in dishonourable and unprofessional conduct during his employment at Saint Elizabeth Health Care in April 2018 by improperly disposing of a patient’s medication, including hydromorphone, by dumping it down the sink; failing to seek authorization prior to practicing draws and disposing of the patient’s medication; failing to provide any education to the patient’s spouse as to the safe disposal of the patient’s medication; sleeping on duty while caring for a different patient, failing to adequately monitor the patient and failing to respond to BiPAP alarms while caring for the patient; in November 2017, by sleeping while on duty caring for another patient and failing to adequately monitor the patient’s oxygen saturation levels; and in May 2018, by failing to promptly reposition a different patient when the patient became agitated and uncomfortable after rolling onto her stomach.

The Discipline Committee ordered that the member’s certificate of registration be suspended for seven months; required the member to appear before the panel to be reprimanded; and imposed the following terms, conditions and limitations on the member’s certificate of registration:
- Must successfully complete specified remedial activities
- Must have nursing mentor for a period of time
- May not engage in independent nursing practice for a period of time
- Must inform employer(s) of results of discipline hearing
- Must inform College of all nursing employer(s) for a period of time
- Employer(s) to provide specified reports to College for a period of time
