Details:
It is alleged that the member committed professional misconduct in that he:
- was found guilty of offences, in or about January 2022, with respect to wilfully interfering with the lawful use and enjoyment of property (mischief), contrary to Section 430(1)(d) of the Criminal Code and wilfully entering falsified records into a computer rendering the computer data meaningless and useless (mischief), contrary to Section 430(5) of the Criminal Code, which are relevant to the member’s suitability to practice the profession;
- contravened the standards of practice of the profession and engaged in disgraceful, dishonourable or unprofessional conduct, in or about May 2019, when he failed to administer medications that had been ordered to be administered to several of his assigned patients; and/or disposed of unused medications for several of his assigned patients in an insecure and inappropriate manner;
- falsified a record relating to the member’s practice, contravened the standards of practice of the profession and engaged in disgraceful, dishonourable or unprofessional conduct, in or about May 2019, when he falsely documented having administered medications to several of his assigned patients, when he had not administered their medications; and/or
- contravened a term, condition, or limitation on his certificate of registration, contravened a provision of the Nursing Act, 1991, the Regulated Health Professions Act, 1991 or the regulations under either of those Acts and engaged in disgraceful, dishonourable or unprofessional conduct by failing to report to CNO when he was found guilty of two criminal offences in January 2022; and/or in or about September 2019, by failing to report to CNO the two criminal charges resulting in the findings of guilt; and/or in or about February 2020, when he was charged with, while knowing a document to be forged, causing or attempting to cause any person to use, deal with or act on the document as if it were genuine, contrary to Section 368(1.1) of the Criminal Code; 26 counts of wilfully interfering with the lawful use and enjoyment of property (mischief), contrary to Section 430(1)(d) of the Criminal Code; and/or 26 counts of wilfully rendering property ineffective or inoperative (mischief), contrary to Section 430(1)(b) of the Criminal Code.

Details:
The Superior Court of Justice found the member guilty of:
- mischief, in interfering with Garden Terrace Nursing Home lawful use and enjoyment of property, contrary to Section 430(1)(d) of the Criminal Code of Canada; and
- mischief, in relation to computer data, contrary to Section 430(5) of the Criminal Code of Canada.
The Superior Court of Justice sentenced the member on March 29, 2022 to the following:
- A conditional discharge; and
- 12-months probation, including, but not limited to the following conditions:
- must notify the court or the probation officer of any change of name or address and must promptly notify the court or the probation officer of any change in employment or occupation;
- must report to the probation officer as directed;
- must attend and actively participate in all assessment, counselling or rehabilitative programs as directed and sign releases to enable the probation officer to monitor attendance and completion; and
- must perform 80 hours of community service work.
