It is alleged that the member committed professional misconduct in that the member:
- misappropriated property from a patient or workplace, contravened the standards of practice of the profession, and engaged in disgraceful, dishonourable or unprofessional conduct by misappropriating narcotics from a facility between September and December 2021;
- was found guilty of an offence relevant to the member’s suitability to practice, and engaged in disgraceful, dishonourable or unprofessional conduct when the member was found guilty of one count of theft under $5,000.00, contrary to Section 334(b) of the Criminal Code of Canada on October 31, 2022;
- contravened a term, condition or limitation on the member’s certificate of registration, contravened a provision of the Nursing Act, 1991, the Regulated Health Professions Act, 1991 or the regulations under either of those Acts, and engaged in disgraceful, dishonourable or unprofessional conduct by failing to report that the member was found guilty on October 31, 2022 of one count of theft under $5,000.00, contrary to Section 334(b) of the Criminal Code of Canada; and/or by failing to report being charged in or about January 2022 with unlawfully stealing Hydromorphone valued at under $5,000.00 in or between August and December 2021, contrary to Section 334(b) of the Criminal Code of Canada, and/or while a trustee of the facility, for the member’s own profit, converting a secure drug dispense code to a use not authorized by the trust with intent to defraud and in contravention of the trust in or between August and December of 2021, contrary to Section 336 of the Criminal Code of Canada; and/or
- contravened a provision of the Nursing Act, 1991, the Regulated Health Professions Act, 1991 or the regulations under either of those Acts, and engaged in disgraceful, dishonourable or unprofessional conduct by failing to report information about any bail condition or other restriction imposed on, or agreed to, in connection with a charge to CNO after the member gave an undertaking to comply with conditions of release in or about January 2022.

It is alleged that the member committed professional misconduct in or between March and April 2020 in that the member:
- misappropriated property from a patient or workplace, contravened the standards of practice of the profession and engaged in disgraceful, dishonourable or unprofessional conduct by misappropriating one or more narcotics prescribed to four patients;
- signed or issued, in the member’s professional capacity, a document that the member knew or ought to have known contained a false or misleading statement, falsified a record relating to the member’s practice, failed to keep records as required, contravened the standards of practice of the profession and engaged in disgraceful, dishonourable or unprofessional conduct by falsifying witness signatures on narcotic disposal forms in the health records of four patients;
- failed to keep records as required, contravened the standards of practice of the profession and engaged in disgraceful, dishonourable or unprofessional conduct by failing to accurately and/or completely document the administration or disposal of one or more of the narcotics on seven occasions; and/or
- contravened the standards of practice of the profession and engaged in disgraceful, dishonourable or unprofessional conduct by accessing the personal health information of a patient, without clinical reason or consent or other authorization.

Details:
The Ontario Court of Justice found the member guilty of:
- theft of hydromorphone vials, the property of St. Joseph’s Healthcare Hamilton, of a value not exceeding five thousand dollars, contrary to Section 334(b) of the Criminal Code of Canada.
The Ontario Court of Justice sentenced the member on October 31, 2022 to the following:
- a suspended sentence; and
- 12-months probation including, but not limited to, the following condition:
- must not be employed or act as a volunteer in any capacity at a place, the primary purpose of which is to dispense controlled drugs and substances.
