Finding Details:
The member was found to have committed professional misconduct in that she:
- contravened the standards of practice of the profession and engaged in dishonourable and unprofessional conduct between October 2015 and December 2016, by sending personal health information on six occasions relating to patients via standard email; authoring and posting a memo in a manner that obscured management’s prior memo and contained inconsistent information from what management had provided to employees previously without authority or approval; removing information from a patient’s chart that should not have been removed; and between May 2011 and January 2017, by storing confidential and personal health information relating to patients on an unsecure USB drive and storing the USB drive in an unsecured location without taking any precautions to protect access to the information; and
- contravened the standards of practice of the profession, gave information about a patient to a person other than the patient or his or her authorized representative without consent and engaged in dishonourable and unprofessional conduct between August and November 2016, by sending personal health information relating to a patient and/or several patients via standard email to her union representative without consent or other authorization and for no clinical purpose; and by opening a patient’s mail and sending an electronic copy of the patient’s bank statement to the patient’s family member without consent or authorization.
Outcome Details:
The Discipline Committee ordered that the member’s certificate of registration be suspended for four months; required the member to appear before the panel to be reprimanded; and imposed the following terms, conditions and limitations on the member’s certificate of registration:
- Must successfully complete specified remedial activities
- Must inform employer(s) of results of discipline hearing
- Must inform College of all nursing employer(s) for a period of time
