The Ontario Court of Justice found the member guilty of:
- sexual interference, contrary to section 151(a) of the Criminal Code of Canada.
The Ontario Court of Justice sentenced the member on June 28, 2016 to the following:
- 18 months probation;
- 5 year prohibition order;
- 10 year Sex Offender Information Registry Act order;
- DNA order;
- 90 days in jail, intermittent sentence;
- section 161 order; and
- a victim surcharge.

The Ontario Court of Justice imposed the following restrictions on the member:
- must not attend a public park or public swimming area where persons under the age of sixteen years are present or can be reasonably be expected to be present, or a daycare centre, school ground, playground or community centre;
- must not seek, obtain, or continue with any paid or unpaid activity that involves being in a position of trust or authority towards persons under the age of 16 years; and
- must not have any contact – including communicating by any means – with a person who is under the age of 16 years unless under the supervision of a person whom the court considers appropriate.

Finding Details:
The member was found to have committed professional misconduct in that he:
- was found guilty of an offence relevant to his suitability to practice in that he was found guilty of touching a person under the age of 16 directly with a part of his body for a sexual purpose;
- contravened a term, condition or limitation on his certificate of registration, contravened a provision of the Nursing Act, 1991, the Regulated Health Professions Act, 1991, and engaged in disgraceful, dishonourable and unprofessional conduct by failing to report to the Executive Director of CNO that he was found guilty of touching a person under the age of 16 directly with a part of his body for a sexual purpose; and
- contravened a term, condition or limitation on his certificate of registration and engaged in disgraceful, dishonourable and unprofessional conduct by failing to report to the Executive Director of CNO that he was charged with committing a sexual assault, touching a person under the age of 16 directly with a part of his body for a sexual purpose, and being in a position of trust or authority towards a young person, touching the young person with a part of his body for a sexual purpose.
