It is alleged that the member committed professional misconduct in that the member:
- was found guilty of offences relevant to the member’s suitability to practise, and in particular:
- on or about February 4, 2019, the member was found guilty of failing to attend court, contrary to Section 145(2)(b) of the Criminal Code; and/or
- on or about September 9, 2021, the member was found guilty of causing death by criminal negligence, contrary to Section 220 of the Criminal Code, and 7 counts of criminal negligence causing bodily harm to 7 individuals between January 2016 and April 2017, contrary to Section 221 of the Criminal Code;
- contravened a term, condition or limitation on the member’s certificate of registration when the member failed to report to CNO that the member had been charged with an offence or found guilty of an offence, with respect to the following charges and findings of guilt:
- on or about May 27, 2017, the member was charged with assault, contrary to Section 266 of the Criminal Code;
- on or about June 28, 2017, the member was charged with breaking and entering with an intent to commit an indictable offence, contrary to Section 348(1)(b) of the Criminal Code, and theft of a value exceeding five thousand dollars, contrary to Section 334(a) of the Criminal Code;
- on or about July 17, 2017, the member was charged with 2 counts of failing to comply with a condition of recognizance, contrary to Section 145(3) of the Criminal Code;
- on or about January 25, 2018,the member was charged with failing to provide the necessaries of life, contrary to Section 215(3) of the Criminal Code, causing death by criminal negligence, contrary to Section 220 of the Criminal Code, and 4 counts of aggravated assault, contrary to Section 268(2) of the Criminal Code;
- on June 5, 2018, the member was charged with failing to attend court, contrary to Section 145(2)(b) of the Criminal Code;
- on June 3, 2019, the member was charged with failing to provide the necessaries of life, contrary to Section 215(3) of the Criminal Code, causing death by criminal negligence, contrary to Section 220 of the Criminal Code, 6 counts of aggravated assault, contrary to Section 268(2) of the Criminal Code, and 6 counts of criminal negligence causing bodily harm, contrary to Section 221 of the Criminal Code;
- on March 18, 2021, the member was charged with aggravated assault, contrary to Section 268(2) of the Criminal Code;
- on or about February 4, 2019, the member was found guilty of failing to attend court, contrary to Section 145(2)(b) of the Criminal Code; and/or
- on or about September 9, 2021, the member was found guilty of the offence of causing death by criminal negligence, contrary to Section 220 of the Criminal Code, and 7 counts of criminal negligence causing bodily harm, contrary to Section 221 of the Criminal Code.

Details:
The Ontario Superior Court of Justice found the member guilty of:
- one count of criminal negligence causing death, contrary to Section 220 of the Criminal Code of Canada; and
- seven counts of criminal negligence causing bodily harm to seven individuals, contrary to Section 221 of the Criminal Code of Canada.
The Ontario Superior Court of Justice sentenced the member on February 9, 2022 to the following:
- 6 years in jail (less 32 days of pre-trial custody) for the count of criminal negligence causing death;
- 5 years in jail, concurrent, for each of the seven counts of criminal negligence causing bodily harm; and
- a DNA order; a prohibition on possession of firearms for 10 years; a prohibition on possession of prohibited firearms for life; and a non-communication order, on each count.
