Finding Details:
The member was found to have committed professional misconduct in that he:
- sexually abused a patient, contravened the standards of practice of the profession and engaged in disgraceful, dishonourable and unprofessional conduct in September 2016 when he made remarks of a sexual nature in the course of performing a pap smear;
- abused a patient verbally, physically and emotionally, contravened the standards of practice of the profession and engaged in disgraceful, dishonourable and unprofessional conduct by making inappropriate remarks to a patient about their height, hair, “modelling career” and how “beautiful” they were, or words to that effect; and touching/stroking the patient for no clinical purpose;
- signed or issued in his professional capacity a document that he knew or ought to have known contained a false or misleading statement, contravened the standards of practice of the profession and engaged in disgraceful, dishonourable and unprofessional conduct in July 2016 when he misrepresented the reason for the quantity of medications prescribed to a patient;
- failed to keep records as required, contravened the standards of practice of the profession and engaged in disgraceful, dishonourable and unprofessional conduct in July 2016 by failing to appropriately document his assessment and prescriptions for one patient; and between April 2017 and May 2018, by failing to appropriately document the care provided to five patients, which included failing to adequately document diagnoses, prescriptions of controlled substances/medications, assessments in relation to those prescriptions, the monitoring of use in relation to those prescriptions and/or any intervention with respect to patients’ potential substance misuse or addiction; and
- contravened the standards of practice of the profession and engaged in disgraceful, dishonourable and unprofessional conduct by telling a patient they could contact him outside of their appointments for no articulated therapeutic need and suggesting to the patient that they should select the medication(s) they wanted to be prescribed; in July 2016, by failing to adequately assess prior to signing prescriptions for one patient; between September 2012 and May 2013, when he performed the controlled act of prescribing, dispensing, selling or compounding a drug, in violation of the Regulated Health Professions Act, 1991 and the Nursing Act, 1991, by signing a prescription for Ativan for one patient and three prescriptions for Lorazepam for another patient; in the Summer of 2016, by failing to maintain appropriate therapeutic nurse-client boundaries with a patient, including asking her out to dinner; and between April 2017 and May 2018, by failing to appropriately formulate and implement an appropriate plan of care for five patients, which included prescribing excessive kinds, amounts and/or doses of controlled substances/medications, without adequate assessments and without adequately monitoring the use of the substances, or when not indicated by the diagnoses, prescribing when he did not have adequate documentation supporting the appropriateness of the prescriptions and/or failing to intervene appropriately with respect to potential substance misuse or addiction.

The Discipline Committee ordered that the member’s certificate of registration be suspended for 10 months; required the member to appear before the panel to be reprimanded; and imposed the following terms, conditions and limitations on the member’s certificate of registration:
- Must successfully complete specified remedial activities
- May not engage in independent nursing practice for a period of time
- Must inform employer(s) of results of discipline hearing
- Must inform College of all nursing employer(s) for a period of time
- Employer(s) to provide specified reports to College for a period of time
