- engaged in disgraceful, dishonourable or unprofessional conduct in or about April to May 2018 by engaging in inappropriate workplace conduct and/or compelling unnecessary nudity in a health education course, when he required students he was instructing in a health education course, who were also his employees, to cut clothing off of one another, including undergarments, such that the students/employees were naked and their genitals were exposed; and/or video recorded the students/employees when they were naked and their genitals were exposed.

- 1 count of assault on 11 persons, contrary to Section 266 of the Criminal Code of Canada.
The Ontario Court of Justice sentenced the member on October 30, 2017 to the following:
- a conditional discharge;
- a DNA order;
- a victim fine surcharge;
- 12 months’ probation subject to the following terms:
- report within two working days and thereafter as directed by the probation officer;
- attend and actively participate in all counselling, rehabilitative programs and assessments as directed by the probation officer;
- not to communicate, directly or indirectly, by any physical, electronic or other means with individuals specified by the court;
- abstain from providing any direct medical services unless there is an acute medical emergency;
- abstain from providing any medical services to athletes or sports teams.

The member was found to have committed professional misconduct in that he:

was found guilty of offences relevant to his suitability to practice in October 2017, and in particular, he was found guilty of assault contrary to section 266 of the Criminal Code, and failing to comply with a condition of a recognizance to abstain from providing any medical examinations/services unless under the direct supervision of a qualified medical doctor or in the presence of a third party with knowledge of these offences and terms of recognizance, contrary to section 145(3) of the Criminal Code; and

failed to abide by a written undertaking given by him to CNO and engaged in disgraceful, dishonourable and unprofessional conduct in May 2017, by conducting an unsupervised physical examination of an individual when the written undertaking required him to abstain from conducting assessments, interventions, communicating diagnoses or providing nursing care or services to any person unless under the direct and physical supervision of a nurse practitioner or physician who was aware of his charges and terms of release.
