The member was charged in Ontario with the following:
- touching the body of a person under the age of 16, directly or indirectly with a part of his body, for a sexual purpose, contrary to Section 151 of the Criminal Code of Canada;
- inviting a person under the age of 16, directly or indirectly with a part of his body, for a sexual purpose, contrary to Section 152 of the Criminal Code of Canada;
- administering to another person, a stupefying or overpowering drug with intent to enable or assist himself to commit sexual assault, contrary to Section 246(b) of the Criminal Code of Canada;
- sexual assault, contrary to Section 271 of the Criminal Code of Canada;
- surreptitiously making a visual recording of a person who was in circumstances that gave rise to a reasonable expectation of privacy, when the person could reasonably be expected to be nude, to be exposing his or her genital organs or anal region, or exposing her breasts, contrary to Section 162(1)(a) of the Criminal Code of Canada;
- possession of property, namely medication of a value not exceeding $5000, the property of London Health Sciences Centre, knowing that said property had been obtained by the commission of an offence, contrary to Section 355(b) of the Criminal Code of Canada; and
- possession of property, namely medication of a value not exceeding $5000, the property of Grand River Hospital, knowing that said property had been obtained by the commission of an offence, contrary to Section 355(b) of the Criminal Code of Canada.

Details:
3(b) For a period of 18 months from the date the member returns to the practice of nursing, the member will notify the member’s employers of the decision. To comply, the member is required to:
i. Inform any employer of the decision prior to commencing or prior to resuming employment in any nursing position;
ii. Ensure that CNO is notified of the name, address, and telephone number of all employer(s) within 14 days of commencing or resuming employment in any nursing position;
iii. Provide the member’s employer(s) with a copy of:
1. the Panel’s Order,
2. the Notice of Hearing,
3. the Agreed Statement of Facts,
4. this Joint Submission on Order, and
5. a copy of the Panel’s Decision and Reasons, once available;
iv. Ensure that within 14 days of the commencement or resumption of the member’s employment in any nursing position, the employer(s) forward(s) a report to CNO, in which it will confirm:
1. that they received a copy of the required documents, and
2. that they agree to notify CNO immediately upon receipt of any information that the member has breached the standards of practice of the profession.
4. All documents delivered by the member to CNO, the Expert or the member’s employer(s) will be delivered by verifiable method, the proof of which the member will retain.

The member gave the following Undertaking to a Peace Officer:
- must notify police of any change in address or employment;
- must not communicate with specified individuals;
- must not be within 50 metres of specified individuals;
- must not be within 200 metres of any place specified individuals are known to reside, be employed, or attend for education;
- must turn all firearms in their possession to the police immediately upon release;
- must abstain from possessing a firearm, ammunition or explosive substances;
- must not engage in any activity that involves contact with persons under the age of 16 years for the duration of the undertaking, unless being supervised by an adult;
- must not attend a park or public swimming area where persons under the age of 16 years are present or can reasonably be expected to be present, or a day care centre, school ground, playground or community centre for the duration of the undertaking;
- must not operate or have the care and control of a device capable of recording, except for the purpose of lawful employment; and
- must not have in their possession prescription medication, unless prescribed to them, or for the purpose of lawful employment.

Finding Details:
The member was found to have committed professional misconduct in or about 2017 to 2019 in that the member:
- contravened the standards of practice of the profession and engaged in dishonourable and unprofessional conduct by engaging in inappropriate interactions with colleagues in the workplace when the member told the member’s co-worker(s) about the member’s sex life with the member’s partner and others; and by failing to maintain the boundaries of the therapeutic nurse-patient relationship with patients when the member provided the member’s telephone number to a male patient; purchased a blanket from the daughter of a patient, and engaged in a personal relationship with a family member of a patient, including but not limited to providing the member’s phone number to the patient’s family member and going for coffee with the family member.
