Details:
The Ontario Superior Court of Justice found the member guilty of:
- for a sexual purpose, touching directly or indirectly, with a part of the body or with an object, any part of the body of a person under the age of 16 years, contrary to section 151 of the Criminal Code of Canada; and
- sexual assault, contrary to Section 271 of the Criminal Code of Canada.
The Ontario Superior Court of Justice sentenced the member on November 17, 2016 to the following:
- 6 months and 23 days in jail;
- 24 months probation including, but not limited to the following conditions:
- must not communicate with or be in the presence of individuals specified by the court; and
- must not be unaccompanied in the presence of persons under the age of 18 years;
- Sex Offender Information Registration Act order for 20 years;
- a weapon prohibition for 5 years;
- DNA order; and
- a victim surcharge.

Finding Details:
The member was found to have committed professional misconduct between October 2013 and November 2016 in that he:
- was found guilty of touching for a sexual purpose, the body of a person under the age of sixteen years and sexual assault contrary to the Criminal Code of Canada, which is relevant to his suitability to practise the profession;
- contravened a term, condition or limitation on his certificate of registration and engaged in disgraceful, dishonourable and unprofessional conduct by failing to provide the Executive Director with details of his charges and findings of guilt;
- contravened the Nursing Act, 1991 by failing to report his findings of guilt to the Executive Director; and
- engaged in disgraceful, dishonourable and unprofessional conduct by failing to inform his employer of his bail condition requiring that he not be alone with any patient under the age of 16.
