Details:

The Ontario Court of Justice found the Member guilty of:

  • Criminal negligence causing death by fraudulently altering the medication administration record of an individual, causing the individual to be administered an increased dose of morphine, contrary to Section 220(b) of the Criminal Code of Canada.

On January 16, 2024, the Ontario Court of Justice sentenced the Member to:

  • 2 years in jail;
  • A victim surcharge of $200;
  • 10-year weapons prohibition; and
  • A DNA order.

Details:

The Ontario Court of Justice found the Member guilty of:

  • Failing to comply with a condition of a release order, contrary to Section 145(5)(a) of the Criminal Code of Canada.

On January 16, 2024, the Ontario Court of Justice sentenced the Member to:

  • A suspended sentence;
  • A $100 victim surcharge; and
  • 9 months’ probation, including the following conditions:
    • Notify of change of name, address, and employment;
    • Report to probation officer as directed;
    • Do not associate or communicate with specified individuals; and
    • Complete all assessment, counselling, or rehabilitative programs as directed.

Details:

The member entered into an Undertaking to permanently resign as a member of CNO as part of an agreed resolution of allegations of professional misconduct heard by a panel of the Discipline Committee.

Finding Details:

The member was found to have committed professional misconduct in January 2015, in that the member:

  • abused a client verbally, physically and/or emotionally and engaged in disgraceful, dishonourable and unprofessional conduct by altering the Medication Administration Record for a patient with respect to morphine dosage without a physician’s order, which caused the patient to be administered an increased dosage of morphine, and which caused the patient’s death; and
  • falsified a record relating to the member’s practice by altering the Medication Administration Record for the patient with respect to morphine dosage without a physician’s order.

Upon consideration of the member’s signed Undertaking for permanent resignation, the Discipline Committee made an Order requiring the member to appear before the panel to be reprimanded.
