Finding Details:
The member was found to have committed professional misconduct in May 2012 in that he:
- sexually abused a client and engaged in disgraceful, dishonourable and unprofessional conduct, when he engaged in touching of a sexual nature, or behaviour or remarks of a sexual nature, towards a client by touching the client’s genitals when there was no clinical purpose to do so; and
- contravened the standards of practice of the profession and engaged in disgraceful, dishonourable and unprofessional conduct when he breached the therapeutic boundaries of the nurse-client relationship with a client by touching the client’s genitals when there was no clinical purpose to do so.

The Discipline Committee ordered that the member’s certificate of registration be revoked immediately, required the member to appear before the panel to be reprimanded, required the member to reimburse CNO for funding up to the amount of $5000 under the program required by s. 85.7 of the Health Professions Procedural Code, required the member to post security to CNO in the amount of $5,000 to guarantee reimbursement of this funding and directed the member to pay costs to CNO in the amount of $135,000.
